My Life In Hell
The laws intended to protect tenants. renters, rent control/ rent stabilization don't in fact work. There are several versions of the rent control/ rent stabilization laws. In 1946 the New York City Legislature enacted a statute which, to the present date, continues to strike fear in the hearts of thousands of property owners.
Known as "Rent Control", the law was initiated in response to a "serious public emergency...created by war, the effects of war and the aftermath of hostilities..." It was felt that unless residential rents and evictions were regulated, "disruptive practices and abnormal conditions will produce serious threats to the public health, safety and general welfare..."
On and after May 1, 1962, rent control of residential units in the City of New York became effective upon the enactment of the New York City Rent and Rehabilitation Law (NYCRRL) #26401. et. seq., of the administrative code.
Rent control applies to buildings of three or more units constructed before February 1947. In municipalities that have not declared an end to the post war rental housing emergency. Rent control is still in effect for now in the five boroughs of N.Y.C and in parts of Albany, Erie, Monroe, Nassau, Schenectady, Oneida, Onodaga, Rensselaer and Westchester counties In order for an apartment to be under rent control the tenant must have been living there continuously since before July 1, 1971. Tenants who did not reside in their units prior to July 1, 1971 are not covered by the statute. When a rent controlled apartment is vacated in N.Y.C or most other .localities, it becomes rent stabilized or completely removed from regulation. It was the position of our legislators that those owners of housing units excluded from "Rent Control"(because they were constructed after February 1, 1947 or decontrolled" for other reasons') were demanding exorbitant and unconscionable rent increases...which led to a continuing restriction of available housing...uprooting long-time city residents from their communities..." Their response to this emergency was to enact the New York City Rent Stabilization Law of 1969(NYCRRL). The protections afforded tenants pursuant to both the Rent Stabilization Law and the Rent Stabilization Code are available to New York City residents if they lease apartments within buildings constructed between February !,1947 and January 1, 1974, containing six or more units. Generally in N.Y.C apartments are under rent stabilization between Feb.1, 1947 and Dec. 31, 1973. Tenants in buildings built before Feb. 1, 1947 who moved in after June 30, 1971 is also covered by rent stabilization. As with Rent Control, the Rent Stabilization Law was enacted in response to what was perceived as a serious public emergency,” It was felt that unless residential rents and evictions (were) regulated and controlled, disruptive practices and abnormal conditions (would) produce serious threats to the public health, safety and welfare..." The statute was further reasoned to be necessary to prevent the "enactments of unjust, unreasonable and oppressive rents and rental agreements..." The protections afforded our citizens by rent stabilization are available outside of the N.Y.C environs and are encompassed within the Emergency Tenant Protection Act of 1974 (hereinafter ETPA). Fourteen municipalities are or were subject to the provisions of the ETPA. The Rent Stabilization Code (hereinafter RSC or code) was adopted to carry out the intent of the "rent Stabilization Law". The code has been through several configurations, with its most recent incarnation having become effective on May 1, 1987. Of initial relevance to this presentation is #2525.5 code; commonly known as the "Harassment" section. This provision makes it unlawful for any person to engage in any course of conduct which interferes with, or disturbs the privacy, comfort, repose or quiet enjoyment of the tenant... or is intended to cause the tenant to vacate such housing accommodation. There is more, but not absolutely necessary at this time. A third category of rent stabilized apartments covers buildings with three or more apartments constructed or extensively renovated on or after Jan.1, 1974 with special tax benefits (as was the situation in my case). Outside N.Y.C, rent stabilized apartments are generally found in buildings with six or more apartments that were built before Jan. 1, 1974. Any building that was built before 1947 and under goes substantial rehabilitation/ renovations loses its rent control/ rent stabilization status. When that rat bastard lesser decided to convert I went into tenant hell; actually I've always been in tenant hell, it's more like tenant legal limbo, because I don't know what my status is, what my rights are. Am I still considered a tenant? Former State senator Joe Bruno now in prison on corruption charges I believe, is responsible for eroding our rent control/ rent stabilization laws; because once a tenant moves out the apartment becomes decontrolled/destabilized. So any apartment with a monthly rent of $2000 or more per month becomes deregulated when it becomes vacant. Also occupied apartments maybe deregulated when the legal regulated rent for the apartment reaches $2000 or more thanks to Joe Bruno. Every thing is predicated on making money.

90% of the time spent by the chassidim is spent in a religious fervor getting worked up to what purpose? To indoctrinate a future generation of parasites with a sense of entitlement that infringes on someone else' right to exist the last 10% is spent influencing politicians to make things go their way, making money so that they can accomplish this, and to live while the rest of us suffer at their hands. They have something in common with the iman at the center of the mosque controversy in lower Manhattan. He is a notorious slumlord just as they are. Who would have thought it, who knew.

My Life In Hell

There was an incident on the subway when I was coming back to this place that illustrates the mind set of the chasidim. I was standing hoping for a seat, I was hot and tired, as soon as a seat became available I grabbed it and sat down. Then something happened that I could not believe, something that completely floored me. As soon as another seat across from me became available the person next to me whom I barely noticed, a woman about 20 darted across to get it. I could not believe my eyes. Never in all my life had I ever seen anything like that. Apparently they have hyper sensitive smellers (noses). I don't think I had anymore of on odor then anyone else; and it was in the 90's. I bathed that day despite the primitive and extremely difficult circumstances forced on me, of having no hot water and no plumbing, since it was with-held by a chassidic Jew Rabbi Abraham Lesser. I spent most of that day in air-conditioning, Not here. Even though I thought I'd seen and experienced it all, yet again they surprised me. I could not believe the rude and disrespectful behavior. Apparently they are never taught about manners, respect for others or impulse control. She had no problem avoiding eye contact. Her behavior did not bother her in the least. I guess I didn't smell to the spoiled, pampered Jewish princess' liking that she had to be obvious about it. I only wish I would have had a camera I would have snapped a picture and posted it. Maybe next time I will. They have no problem wasting resources like electricity. That doesn't bother them. They burn lights all night when no one is even around. They also have no problem with-holding vital services such as hot water etc. Poor, poor her, her dainty and delicate sensibilities were offended, The one thing these monsters never developed was, is a conscience or empathy for others. They truly are psychopaths.Who would do anything and everything to get what they want, they could not live or survive without the creature comforts they have, yet they expect me to.

There are no grass roots tenants rights/advocacy groups/organizations started by tenants themselves. You have to advocate for yourself and what good does that do when the laws favor the owners of these slum buildings; and the majority of owners are rich jews who own the ledgislators,lawmakers and judges. Public Advocate Bill DiBlasio has posted the names of slumlords to shame and embarass them. Yet when I asked him for help that corrupt self-serving, hypocritical shit-heel didn't give a f--k. If he didn't owe his election to the Jewish Alliance maybe he'd have actually done something, even respond. He is bought and paid for by scumlords like Rabbi Abraham Lesser of 1481 47th St. Brooklyn, N.Y. 11219. He is owned by them. Hey Bill why don't you see how the other half live at 1416-1420 and 1424 43rd St., B'klyn N.Y. 11219 Borough park; with no hot water and on Oct.15th no heat, and mold, Yesterday began Rosh hashana the start of the high holy days. Once Rabbi Lesser has atoned for the sins, and there are too many to count he will be right back to committing more. There are also broken and missing tiles and fixtures in the bathroom that have to be replaced. There was never any intention on the part of anyone from Baltic St. AEH to actually ever do anything to help me with my housing situation which has developed into a full blow crisis. The intent was never there. Commissioner Sharon E. Carpinello you know no shame, unless this effects you, you don't give a shit. No matter what the guidelines governing allocations for funding these peer advocacy centers were you don't stand on ceremony when someone is in desperate straits, you are flexible, you make allowances not excuses. You take the initiative if there are tenents rights/advocacy places that can provide answers and solutions to my dilemma. They have a legal as well as a moral obligation to get off their ass's and do everything they can possibly do and then some, to make sure I have a safe, clean, habitable home and all the services to which I am entitled to, but not getting while still paying rent. To find out if I'm still considered a tenent with a tenents rights. Whether the law has any teeth to it and isn't all bark with no bite. No one should call themselves an advocate if that isn't what they do. An advocate is supposed to advocate on behalf of someone who can't advocate for themselves, anything less is horse crap. You don't deprive someone of basic services such as hot water, and on Oct. 15th heat. I want to know if I take the bastard to court, the courts will enforce the law despite the fact that this place is considered a school, and someone will go with me? Do you, does anyone comprehend DEPRAVED INDIFFERENCE!!!? I'm unable to sleep I'm so scared. I'm wracked with fear, worry,and trepidation. How can AEH do an effective, let alone competent job if they don't know what's going on with their client, because they don't take an interest. They don't see for themselves what's happening? How is the client served, more important how are they protected? Does anyone know the true nature of my situation, the absolute hell I'm going through? Why don't you ask them, why don't you ask those geniuses if they know what is actually going on? When the so called advocates couldn't give a f--k? I'm sure you know their address. If their excuse is that they can't do anything because they're not allowed to or don't have the time then their full of it. It's always possible to get around something and make the time, you just have to want to, have to be flexible. An advocate has one sole concern and it isn't for themselves, it is to make sure they do anything and everything, whatever it takes to look after and protect their clients at all cost. AEH isn't doing this. The next time I go to AEH I want them to cut the horse crap and be honest for once in their miserable lives, if they even know how to, they're clueless. But I can't twist anyone's arm, if they don't want to help me then there is nothing I can do to make them, but they have no right to ostracize me for telling the truth about what really goes on there, and no one is doing anything about it. All I'm doing is reporting waste and abuse. The people who need help the most(me for one) are not getting the help we so desperately need. I'm the one who is going to freeze this winter, not them, not you. At your stage in life I guess it's difficult to develop a conscience and do the right thing.
